This notice describes how the site is managed with regard to the processing of the personal data of users who browse it, as well as the data-processing practices for data sent by the data subject to the Data Controller through this site. This notice is provided pursuant to art. 13 of Legislative Decree no. 196/2003 – Personal Data Protection Code to those who interact with the website (hereinafter the “Site”) of Azienda Agricola di Miracco Atanasio Franco, Contrda Arlino 17/A 87048 Santa Sofia d'Epiro (CS) Italy, VAT no. IT03465910788, accessible at: www.agricolamiracco.it.
The Data Controller
Following consultation of the Site, or voluntary registration on it, users’ personal data may be processed. The “controller” of such processing is Miracco Atanasio Franco
Purposes of Processing
As better explained in the sections that allow users to join—by providing their personal data—the services reserved for Site users, the data of the users concerned are processed in order to respond to requests expressly made by them. In particular, all data-collection activities and subsequent processing are aimed at pursuing the following purposes:
- registration on the Site;
- subscription to email newsletters;
- sharing content on the site;
- general request for information;
- registration for events and initiatives;
The Controller will not use the data provided for purposes other than those connected with the service, among those listed above, to which the user concerned has subscribed, or only within the limits indicated from time to time in any further specific notice accompanying the different and particular service requested by the user.
Appointees, Processors and Places of Data Processing
The data will be processed by the company through its own appointees belonging to the administration and marketing areas, depending on the purpose to be achieved on the basis of the data subject’s request.
How We Process Data
All processing carried out within this site will be performed using electronic or telematic tools, but may also be carried out with paper/manual tools. Data will be processed with logic related to the purposes for which the data were collected and in compliance with current security rules, for the purposes indicated above or specified from time to time in any further notices provided to the user.
Personal data will be processed for the time strictly necessary to pursue the purposes for which they are collected. Types of data processed and optional nature of providing them The forms to be completed on this site may include both data that are strictly necessary to subscribe to what is of interest and whose omission does not allow the request to be processed, and data whose provision is optional and not strictly necessary to process the request.
Browsing Data
The computer systems and software procedures used to operate this website acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. This is information that is not collected to be associated with identified data subjects, but which by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes IP addresses or domain names of the computers used by users who connect to the site, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numeric code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user’s operating system and IT environment. These data are used solely to obtain anonymous statistical information on the use of the site and to check its correct functioning and are deleted immediately after processing. The data could be used to ascertain liability in the event of hypothetical computer crimes against the site: except for this possibility, at present the data on web contacts do not persist for more than seven days.
Data Voluntarily Provided by the User
The personal data normally required to use the services of this site are identification and contact details. The optional, explicit and voluntary sending of email to the addresses indicated on this site or the completion of electronic contact forms entails the subsequent acquisition of the sender’s address, necessary to respond to requests, as well as any other personal data included in the message. Specific summary notices will be progressively reported or displayed on the pages of the site set up for particular on-demand services. Normally, sensitive data pursuant to art. 4 of Legislative Decree 196/2003 are not processed (in the event that sensitive data are processed for certain services, a specific notice will be provided and specific consent will be requested from the user concerned).
Cookies
Cookies are small text files that the sites visited by the user send and store on their computer or mobile device, to be then retransmitted to the same sites on the next visit. Thanks to cookies, the site remembers the user’s actions and preferences (such as login data, chosen language, font size, other display settings, etc.) so that they do not have to be indicated again when the user returns to visit that site or browses from one page to another. Cookies, therefore, are used to perform computer authentication, session monitoring and storage of information regarding the activities of users who access a site and may also contain a unique identification code that allows tracking of the user’s navigation within the site itself for statistical or advertising purposes. While browsing a site, the user may also receive on their computer or mobile device cookies from sites or web servers other than the one they are visiting (so-called “third-party” cookies). Some operations could not be carried out without the use of cookies, which in certain cases are therefore technically necessary for the operation of the site itself. There are various types of cookies, depending on their characteristics and functions, and these can remain on the user’s computer or mobile device for different periods of time: so-called session cookies, which are automatically deleted when the browser is closed; so-called persistent cookies, which remain on the user’s device until a preset expiry date. Under current Italian law, the use of cookies does not always require the user’s express consent. In particular, “technical cookies” do not require such consent, i.e., those used solely to transmit a communication over an electronic communications network, or to the extent strictly necessary to provide a service explicitly requested by the user. In other words, these are cookies essential for the operation of the site or necessary to perform activities requested by the user. Among technical cookies, which do not require express consent for their use, the Italian Data Protection Authority (see Gen. Prov. “Identification of simplified procedures for the notice and acquisition of consent for the use of cookies – 8 May 2014”) also includes:
- “analytics cookies” where used directly by the site operator to collect information, in aggregate form, on the number of users and how they visit the site,
- navigation or session cookies (for authentication),
- functionality cookies, which allow the user to browse according to a set of selected criteria (for example, language, products selected for purchase) in order to improve the service provided.
For “profiling cookies”, on the other hand, i.e., those aimed at creating profiles relating to the user and used to send advertising messages in line with the preferences expressed by the user while browsing the web, the user’s prior consent is required.
– Types of cookies used by the Site and possibility of (de-)selection The Site uses the following cookies, offering the possibility to (de-)select them, except for third-party cookies for which the user must refer directly to the relevant selection and de-selection methods for the respective cookies indicated below via links:
- Technical cookies—navigation or session cookies, strictly necessary for the operation of the Site or to allow the user to use the content and services requested.
- Technical analytics cookies, which make it possible to understand how the site is used by users. With these cookies no information is collected on the user’s identity, nor any personal data. The information is processed in aggregate and anonymous form.
- Technical functionality cookies, i.e., used to activate specific site functions and a set of selected criteria (for example, language, products selected for purchase) in order to improve the service provided.
WARNING: by disabling technical and/or functionality cookies the Site may not be viewable or some services or certain functions of the Site may not be available or may not work properly, and the user may be forced to change or manually enter certain information or preferences each time they visit the site.
- Technical session cookies for the operation of the site - Third-party cookies, i.e., cookies from sites or web servers other than that of the Controller, used for purposes of those third parties, including profiling cookies. It is specified that such third parties, listed below with the relevant links to their privacy policies, are independent data controllers of the data collected through the cookies they provide; therefore, the user must refer to their personal data processing policies, notices and consent forms (selection and de-selection of the respective cookies) indicated below (as specified in the Gen. Prov. Identification of simplified procedures for the notice and acquisition of consent for the use of cookies – 8 May 2014):
- https://support.twitter.com/articles/20170519
- https://www.facebook.com/policy.php
- https://www.linkedin.com/legal/privacy-policy
– How to view and change cookies through your browsing program (so-called browser) The user can select which cookies to authorize through the specific procedure provided below, as well as authorize, block or delete (in whole or in part) cookies also through the specific functions of their browsing program (so-called browser): however, if all or some cookies are disabled, it is possible that the Site may not be viewable or that some services or certain functions of the Site may not be available or may not work properly and/or the user may be forced to change or manually enter certain information or preferences each time they visit the Site.
Optional Nature of Providing Data Other Than Browsing Data
Apart from what is specified for browsing data, the user is free to provide the personal data shown in the registration/subscription forms (some with a specific and separate request for informed consent for processing that requires it) or otherwise indicated in contacts to request the sending of information material or other communications. The optional, explicit and voluntary sending of email to the addresses indicated on this site, or through communication forms, entails the subsequent acquisition of the sender’s address, necessary to respond to requests, as well as any other personal data included in the message.
Rights of Data Subjects
The persons to whom the personal data refer have the right at any time to obtain confirmation of the existence or otherwise of such data and to know their content and origin, verify their accuracy or request their integration or updating, or rectification (art. 7 of Legislative Decree no. 196/2003). Pursuant to the same article, one has the right to request deletion, transformation into anonymous form or blocking of data processed in violation of the law, as well as to object in any case, for legitimate reasons, to their processing. Requests must be addressed to the Controller’s physical address or by email to [email protected]
